Selling your stuff - EULA/license

I’m about to upload my latest creation to the Creative Crash marketplace. This will be the first time I’m actually selling something instead of giving it away for free, so naturally there are a few more things that I need to keep in mind.

I know that sooner or later, some studio is going to ask me for an EULA (has happend in the past, regarding my free stuff) or more info about the license, and to be frank here: I do not know a whole lot about EULA’s and software licenses. In the past I’ve just gone with a Creative Commons -license for my free stuff - but that kind of license is restricted to non-commerical stuff, so I’m wondering if there is any similiar place where I can generate a license text but for commercial products?

I’ve been told to stay away from site licenses (one license per studio - instead of one license per X seats) as it would mean I get the same amount of money for an individual license as I would for a studio license… so yeah, I got that covered - and the price ofc. Now I just need a EULA.

Thoughts/Advice?

You don’t need a EULA per se if you are selling to an individual vendor and not creating a tool you will sell to multiple largely anonymous people. In this case, you should be creating a contract for your jobs that spell out the terms of your work. Who owns the source code? Are you performing work for hire, or are you providing a tool? Are you reserving the right to resell the software at a later date? You add this stuff along with the other terms you would normally spell out in a contract: Arbitration clause, payment terms, delivery dates, etc.

I’m selling a tool via Creative Crash (so it will be available for download immediatly). I own the source code. Im not performing work for hire - Im providing the tool (and support for it).
As for the other things you list: that’s what I need to find a template for.

You should be able to cobble together something from the resulting links.

Awesome, thanks a bunch!

OT: You’ve probably heard this before, but I think that your avatar really gives the illusion of an African grey parrot
